The WTW Private Equity & Transactional Solutions Industry Vertical Division is dedicated to providing exceptional service and innovative solutions to private equity sponsors and strategic buyers. We are seeking an experienced and highly motivated Transactional Insurance Claims Advocate to join our team. The successful candidate will be responsible for managing and overseeing transactional insurance claims (including representations and warranties, tax, and contingent insurance-related matters), keeping accurate and current records of those claims, communicating regularly with the broking team with respect to claims status and outcomes, and contributing to marketing materials and thought leadership. The Role - Oversee and manage the full lifecycle of transactional insurance claims (representations and warranties, tax, and contingent), including:
- Reviewing transaction documents, such as purchase agreements and disclosure schedules and policy documents to help assess the basis of potential claims and potential coverage issues
- Providing advice and counseling in advance of filing the claim, and assisting the client and the client’s attorneys in understanding the claims process;
- Supporting client’s counsel in drafting the initial claims notice (and any subsequent updates) and submitting to the carrier(s);
- Collaborating with underwriters, advisors, and legal teams to ensure a coordinated approach to claims resolution;
- Participating in claims resolutions processes including alternative dispute resolution;
- Assisting in drafting and finalizing settlement agreements, as necessary.
- Liaising with external legal counsel, forensic accountants, and other experts as necessary to support claims resolution.
- Serving as the primary point of contact for clients during the claims process, providing expert advice and clear communication.
- Guiding clients on the documentation required, timelines, and strategies for optimal claim outcomes.
- Maintain current data about status of newly filed, ongoing, and resolved claims, and coordinate with TIS leadership to keep the TIS broking team apprised of claims status, policy wording improvements and claims trends. This will include systematizing claims record-keeping and tracking, as well as liaising with the broking team.
- Contribute on an ongoing and as-needed basis to marketing material generated by the TIS team including an annual claims report.
Qualifications
The Requirements
- Bachelor’s Degree and Juris Doctor or LLB degree.
- Minimum of 5+ years of legal experience; preference for attorneys with a background in insurance policyholder work and/or knowledge of M&A-related litigation, and particular preference for attorneys experienced with transactional insurance claims (representations and warranties, tax, and contingent).
- Strong written and verbal communication skills, including experience in drafting legal documents and communications.
- Experience with negotiating against adverse parties while maintaining a collaborative and collegial atmosphere.
- Exceptional interpersonal skills, including the ability to effectively advise clients, build relationships with insurers’ claims-handling professionals and counsel, and work collaboratively with the TIS broking team.
- Excellent time-management and organizational skills, and an ability to act proactively on clients’ behalf while allowing clients’ counsel to lead claims-management efforts.
- Proficiency in Microsoft Office (Word, Excel, PowerPoint).
Compensation And Benefits
Base salary range and benefits information for this position are being included in accordance with requirements of various state/local pay transparency legislation. Please note that salaries may vary for different individuals in the same role based on several factors, including but not limited to location of the role, individual competencies, education/professional certifications, qualifications/experience, and performance in the role.
Compensation
The base salary compensation range being offered for this role is $275,000 - $425,000 USD. This role is also eligible for an annual short-term incentive bonus.
