The Opportunity:
The Fund Chief Compliance Officer will play a critical and highly visible role in ACA’s Fund Officer group. The Fund Chief Compliance Officer will typically prepare and administer the compliance programs for 4-5 fund complexes, serve as an AML compliance officer for certain fund complexes, evaluate compliance programs maintained by the funds’ advisers and sub-advisers, as well as those maintained by third-party mutual fund/ETP service providers and serve as project manager on various consulting engagements that do not require named officer services
What you’ll do:
- Serving as named Fund Chief Compliance Officer and Anti-Money Laundering Compliance Officer for multiple 1940 Act registered clients, review and administer client Fund Companies’ compliance program policies and procedures
- Review and evaluate those policies and procedures of the adviser, sub-adviser, administrator, principal underwriter and transfer agent (collectively, “Service Providers”) that relate to the Fund Companies and their Funds
- Conduct periodic reviews of the Fund Companies’ compliance programs and incorporate any new or changed regulations, best practice recommendations or other guidelines that may be appropriate
- Review, no less frequently than annually, the adequacy of the policies and procedures of the Fund Companies and their Service Providers and the effectiveness of their implementation, Design testing methods for the Fund Companies’ compliance program policies and procedures based upon a risk assessment of compliance areas and conflicts applicable to the Fund;
- Perform and document periodic testing of certain key control procedures (as appropriate to the circumstances), including reviewing reports, investigating exceptions, and making inquiries of Fund Companies’ management and Service Providers
- Conduct periodic site visits to the adviser and other Service Providers, as necessary
- Mentor and train junior staff members
- Communicate with Foreside personnel and clients on various matters
- Conducts self in a professional manner
- Responsible for reporting to senior management, including any potential or perceived violations of applicable laws, rules or Company policies
- Other tasks, special projects and duties as assigned
To qualify for the role you must have:
- Bachelor’s degree
- JD desirable; but not required
- Current or recent work experience (3+ years) serving as named Fund Chief Compliance Officer or deputy compliance officer
- 10-15 years work experience in 1940 Act compliance, legal or fund administration roles
- Strong knowledge of Exchange Traded Funds, Mutual Funds and/or Closed End Funds
- Detailed knowledge of the 1940 Act and Rule 38a-1
- Strong knowledge of Investment Advisers Act
- Comfort and familiarity with AML programs and Bank Secrecy Act requirements
- Strong organizational and analytical skills
